AirTight Networks Sues Aerohive Networks For Patent Infringement

AirTight's patent covers its highly effective rogue detection technique

Mountain View, CA -- January 28, 2013 -- AirTight® Networks has today filed suit (CV-13-0383) against Aerohive Networks alleging that Aerohive has willfully infringed AirTight's U.S. Patent No. 7,339,914, which issued March 04, 2008, by making, using and selling wireless network products including Aerohive's Hive Access Points (Hive APs). AirTight alleges that Aerohive has willfully infringed the '914 patent for at least several years, and has also induced and continues to induce infringement by Aerohive's customers as they continue to use the infringing Hive APs. AirTight's patent covers its highly effective rogue detection technique, commercially called Marker Packets&trade, which facilitates fast, accurate, and reliable detection of in-network rogue access points.

In 2009, Aerohive and AirTight entered into a partnership agreement that was intended to give Aerohive's customers access to AirTight's patented and highly acclaimed wireless intrusion prevention system (WIPS). However, AirTight alleges that Aerohive instead misappropriated AirTight's patented technology and incorporated it into its own products, including Hive AP's.

AirTight is seeking damages for Aerohive's past infringement, as well as an injunction against continuing infringement by Aerohive and its customers. AirTight is also seeking enhanced damages and attorneys' fees because Aerohive's infringement has been willful, done with full knowledge of AirTight patents and technology.

AirTight further alleges that Aerohive has not taken the necessary steps to avoid ongoing infringement by itself or its customers. and instead continues to support ongoing infringement. AirTight thus alleges that the patent infringement, which it brought to the attention of Aerohive, is still ongoing.
