@Whoopty: That's because it was a government organization and a screwup at high levels.

Had this been a company in the private sector -- especially a major company -- heads would have rolled and sacrificial lambs would have been offered to appeal regulators.

Yea it's actually quite interesting. That's been a big revelation as part of the investigation into the hack of the OPM, where the CIO just had so little knowledge on how to combat the attack, downplayed how bad it was and wasn't even culpable. That's one big change that's coming.

Exec insulation from liability
For the past couple of years, this has been a burgeoning issue in negotiating executive employment agreements, actually -- insulation from liability.  Indemnification language, D&O insurance, and the like are all subjects that are on the table now in the wake of headline-grabbing mega breaches.
